Terms of Use — toMate

toMate is a non-commercial personal pet project, created and maintained by an individual developer and provided free of charge, "as is". These Terms of Use (the "Terms") form an agreement between you and that developer ("we", "us", "toMate") and govern your use of the toMate mobile application (the "App") and any related services.

By creating an account, signing in, or using the App in any way you confirm that you have read, understood, and accepted these Terms and our Privacy Policy. If you do not agree, do not use the App.


1. Who we are

toMate is a personal, non-commercial pet project run by an individual developer — there is no company or registered business behind it. All enquiries go to a single email address:


2. Eligibility

You may use the App only if all of the following are true:

  1. You are at least 16 years old. If you are under 18, you confirm that you have your parent or legal guardian's permission to use the App and to meet other users in person.
  2. You have the legal capacity to enter into a binding contract in your jurisdiction.
  3. You are not barred from using the App by a previous decision of ours, by an applicable court order, or by applicable law (including international sanctions).
  4. Your account is created and used by you personally, not on behalf of someone else without their informed consent.

We may, at our discretion and where legally required, ask you to verify your age.

4. Acceptable use

You agree that you will not, and will not assist anyone else to:

  1. Post content that is unlawful, fraudulent, threatening, defamatory, sexually explicit involving minors, or that incites violence or hatred on grounds of race, ethnicity, religion, gender, sexual orientation, disability, or nationality.
  2. Use the App to harass, stalk, or intimidate another user.
  3. Create fake or misleading activities (fictional meetups, scam events, undisclosed commercial promotions).
  4. Solicit payments, donations, sales, or services through the App without our prior written permission, except for casual splitting of expenses between participants of an activity.
  5. Collect data from other users' profiles, activities, or messages by scraping, automated tools, or any other means.
  6. Reverse-engineer, decompile, or circumvent the technical protection measures of the App.
  7. Interfere with the operation of the service (denial-of-service attempts, exploiting vulnerabilities, spam).
  8. Use the App to violate any applicable law, regulation, or third-party right.
  9. Use the App to organise meetings that involve illegal substances, weapons, or other illegal activity.

We may remove content, restrict features, or terminate accounts in response to violations of this section.


5. Activities and in-person meetups — safety

toMate is a platform that helps you discover and propose activities. We are not a party to, do not organise, and do not supervise any meeting that happens off the App. Meeting other people you have not previously met carries inherent risk. By using the App you accept that:

  1. You are solely responsible for your decision to attend or host any activity, and for your safety before, during, and after it.
  2. You will exercise your own judgment about whether to share personal contact details, your home address, or your real-time location with another user.
  3. If you are under 18, you will inform a parent or guardian of where you are going and with whom before attending an in-person meetup, and you will avoid meetings that take place in private residences or in non-public venues.
  4. Hosts are responsible for complying with applicable laws (permits, age-restricted venues, food safety, etc.).
  5. We do not screen, vet, or background-check users.

If you see or experience harmful behaviour, report the user from their profile or report a specific message from the chat. In an emergency, contact local emergency services first. Reporting through the App is not a substitute for contacting the police.

8. Blocking, reporting, and moderation

If you believe an enforcement action against your account is wrong, you can appeal by emailing romanzhykhor@gmail.com within 30 days of the action.


9. Phone-number verification

We use Firebase Authentication to send the SMS one-time password. You are responsible for any standard SMS or data charges your mobile carrier applies. We may temporarily rate-limit your phone number if repeated SMS-delivery failures or carrier abuse are detected.

The App relies on services provided by Apple, Google (Firebase, FCM), Hetzner, Sentry, the OpenStreetMap Foundation, and others (see the Privacy Policy for the full list). These third parties have their own terms and privacy practices.

The map data displayed in the App is supplied by © OpenStreetMap contributors under the Open Database License.


12. Intellectual property in the App

The App itself — source code, design, logos, trade marks (including "toMate"), texts — is owned by us or our licensors. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App for your private, non-commercial use of the service.

You may not copy, modify, distribute, sell, or create derivative works based on the App, except as expressly permitted by these Terms or applicable mandatory law.


13. Updates to the App

We may release updates through Apple App Store, Google Play, and our over-the-air update channel. Some updates may be required to continue using the service.


14. Disclaimer of warranties

To the maximum extent permitted by Ukrainian law, the App is provided "as is" and "as available", without warranties of any kind, express or implied. We do not warrant that the App will be uninterrupted, error-free, or secure, or that activities listed by other users will take place or be as described.

Nothing in this section limits any rights you have under mandatory consumer-protection law.


15. Limitation of liability

toMate is a free, non-commercial pet project offered "as is", with no commercial relationship between you and the developer. To the maximum extent permitted by applicable law, the developer accepts no liability whatsoever for any loss, damage, injury, or claim of any kind — whether direct, indirect, incidental, special, consequential, or punitive — arising out of or connected with your use of the App or your participation in any activity, including (without limitation):

Nothing in this section excludes or limits liability that cannot be excluded under mandatory law (for example, liability for death or personal injury caused by intent or gross negligence).


16. Your responsibility

You are responsible for how you use the App and for the content you post. If a third party brings a claim against the developer because of your unlawful conduct, your breach of these Terms, or content you posted, you agree to take responsibility for that claim to the extent the law allows.


17. Changes to these Terms

Material changes will be announced via an in-app notice and an email to the address associated with your account at least 30 days before they take effect. Continued use of the App after the effective date constitutes acceptance.


18. Governing law and dispute resolution

These Terms are governed by the laws of Ukraine, excluding conflict-of-laws rules.

Disputes are first attempted to be resolved by direct negotiation (write to romanzhykhor@gmail.com). If unresolved within 60 days, the dispute may be referred to the competent court determined by applicable law, save that consumer-protection rules of your country of habitual residence may give you the right to bring proceedings before a court closer to you.
